The CEO would be a good start. Somehow didn't think it would get a good response. Paypal don't listen to anyone, just carry on in their own sweet way ignoring everyone.

Forget the Information Commissioner, they are cdompletely toothless, I have a long standing complaint with the IC about a company going back over 15 months now, a complaint that I see as fairly straightforward and would be easy for them to give the company a good rollicking based on the proof I have given them.   To date they have done sod all, only waste my time. I don,t even bother replying to their letters now, they have no interest in helping small businesses.

On another note about Paypal selling customer lists, how do they get around the Data Protection Act with this type of action? I know they are based abroad, but still they will have to comply when dealing with UK based customers?

I've received a call from my PayPal Business Manager regarding the email I sent to her regarding disclosure of confidential information to third parties and she has assured me that I (along with others) have misunderstood the policy change announcement and that I have nothing to worry about as none of my customers details will be 'sold' to marketing companies.

Hi Nick,

Interesting, and a lot to wade through. Also interesting that I have been unable to obtain clarification from PayPal with all my emails to them about exactly what they will be "passing on". The attitude has been "you can close your account" or "The decision has been taken and your objections are noted on your account".

I've also quickly read the policy from the link you provided and it still does indeed mention Marketing companies and suspiciously I can NOT find "Carrenza" in the text - which is the company mentioned in the original Privacy Policy amendment at the end of the Terms and Conditions they sent to us. So I am still looking for a more explicit statement - although I must admit I need to read the whole thing. I asked PayPal if they could include a statement along the lines of:-

"If you are a business using the PayPal payment gateway to take credit/debit card payments for the sale of products and/or services then we will NOT disclose any of YOUR customer's details (Customer Name, Customer Address or Customer email) to any third party for marketing purposes"

They have NOT agreed to that - so I remain convinced. I am sure we will tie it down because I contacted the BBC to try and advertise the issue - Simon Gompertz will be here at 11am to do a piece to be aired on BBC2's Working Lunch program sometime next week. If ANYONE can tie the PayPal CEO down - they can - hopefully.

Hi Folks,

I did try to resist the "fame" bit - I hate hearing myself on tape (I was a cockney - now an Essex lad!) let alone seeing my ramblings on video - but they were keen and I wanted them to get a definitive answer from PayPal. Please go easy on our appearance. As far as I know, the piece will be aired next Tuesday BBC2 Working Lunch at 12:30.

I gather from Simon Gompertz that they are talking to PayPal today.

Hi Folks,

OK, so my moment of "fame" didn't go too badly. It was good to see the subject aired and also Rob Skinner of PayPal UK say they've been doing it all the time and had decided to make things "clear" - I wish I had known when I first looked at them. However, according to Simon Gompertz, PayPal told him they "only passed on this data to provide their service", but did confirm that "they would be passing on customer data even if those customers were NOT PayPal customers and were just ordering using credit/debit cards". I fail to see how passing on non-PayPal customer data to a marketing company is required to "provide their service". I think that Rob Skinner was continuing the "smoke and mirrors" approach rather than "making things clearer" as he thought they should.

Time to look for a new payment gateway - and let my customers know why the change.

Thanks for all the support, it was good to pass things by you folks just to make sure I hadn't got hold of the wrong end of the stick.

Case Closed I think - GUILTY.
